Q: Is the policy available in all States?
A: Yes, this policy is available in all States.
Q: Why do I need Professional Liability Insurance??
A: Professionals are held to a higher standard of performance. You can do everything right, and still have a malpractice claim against you, and dealing with a claim can be expensive. That is why you need to buy Professional Liability Insurance. We can help protect your assets.
Q: What is Miscellaneous Professional Liability Insurance??
A: MPL policies have been designed to provide coverage to the non-traditional professional, who are not covered under specific E&O policies. In our ever changing economy, there are new professions created everyday. Our policy is tailored to your needs, through our Definition of Professional Services.
Q: Who writes the Definition of Professional Services??
A. The Definition of Professional Services, item 8 of the Declaration page, is the most important part of the policy. This definition determines what will be covered under the policy. In specific E&O policies, such as Lawyers Professional Liability, the “professional services” is pre-defined in the policy. The definition of professional services is what makes the MPL policy unique for each Insured. We create the definition of professional services from the application and through discussions with the Insured.
Q: Who is covered under the policy??
A: You are covered under this policy, as well as any of your employees, partners, directors or officers.
Q: Are Independent Contractors covered under the policy??
A: Independent Contractors are not considered employees, and are not automatically covered under the policy. If the Insured uses Independent Contractors, they must specifically request that the IC be added to the policy via endorsement. The IC will be covered only for professional services provided on behalf of the Insured.
Q: What is typically NOT covered under a Professional Liability Policy?
A: This is not an exhaustive list of all exclusions. Please refer to the policy.
-Fraudulent, Criminal or Malicious acts
-Services provided to a business enterprise that is owned
-Bodily Injury or Property Damage
-Claims arising from services that were performed prior to the retro date of the policy
Q: What is a Claims Made form??
A: This is the industry standard policy form for professional liability. It requires that the Claim must be first made against the Insured and reported to Claims Representatives during the policy term.
Q: Is Prior Acts Coverage available??
A: If the Insured has had continuous coverage, we will provide prior acts coverage.
Q: Who do we report claims to??
A: If you are sued, or if you have been threatened with a suit, you should report this immediately. The Claim will be managed by a highly experienced law firm located in Chicago, Illinois.
